
🛡️ Justice Upheld in POCSO Case: A Landmark Victory for Fair Trial Rights

In a recent POCSO (Protection of Children from Sexual Offences) case, our client was falsely implicated and was denied a fair opportunity to defend himself. Shockingly, despite the legal mandate, the video footage of the victim’s statement recorded by the Investigating Officer—a crucial piece of evidence—was not supplied to the accused.
The trial court refused to entertain a petition filed by the accused requesting a copy of this essential video footage. Denying such access directly violated the principles of natural justice and the right to a fair trial under Article 21 of the Constitution of India.
đź’Ľ Taking strong exception to this injustice, we approached the Hon’ble High Court through a criminal petition, arguing that without access to the recorded statement, the accused was being deprived of effective legal defense.
📜 The Hon’ble High Court intervened promptly and directed the trial court to supply the video footage of the victim’s statement to the accused, upholding the constitutional and procedural safeguards.
🔍 This judgment reinforces that no accused can be denied access to evidence, especially when it directly affects their ability to prove innocence. The High Court’s order is not only a personal victory for the client but also a landmark reminder of the judiciary’s role in safeguarding the rights of the accused.
